These Terms of Service (“Terms”) govern your access to and use of Innsight’s website and property management platform (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility & Accounts
You must be at least 18 years old and authorised to bind your business to these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
2. Use of the Service
Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable right to use the Service for your internal business operations. You agree not to:
- Use the Service for any unlawful, fraudulent or unauthorised purpose.
- Attempt to gain unauthorised access to the Service or its related systems.
- Reverse engineer, copy, resell or sublicense any part of the Service.
- Interfere with or disrupt the integrity or performance of the Service.
- Upload malicious code or content that infringes the rights of others.
3. Customer Data
You retain all rights to the data you and your guests submit to the Service (“Customer Data”). You grant us a limited licence to host, process and transmit Customer Data solely to provide and improve the Service. You are responsible for the accuracy and legality of Customer Data and for obtaining any consents required from your guests.
4. Fees & Payment
Paid plans start at ₹1,000 + 18% GST per property, per month, unless otherwise agreed. Fees are billed in advance and are non-refundable except where required by law. We may change pricing with prior notice; changes take effect at the start of your next billing cycle.
5. Third-Party Integrations
The Service integrates with third-party channels and OTAs (such as Booking.com, Airbnb and Agoda). Your use of those services is governed by their own terms, and we are not responsible for their availability, accuracy or actions.
6. Intellectual Property
The Service, including its software, design, trademarks and content, is owned by Innsight and protected by applicable laws. These Terms do not grant you any ownership rights in the Service.
7. Service Availability
We strive to keep the Service available and reliable but do not guarantee uninterrupted access. We may modify, suspend or discontinue features, and perform maintenance, from time to time.
8. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if required by law. Upon termination, your right to use the Service ceases; provisions that by their nature should survive will continue to apply.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, Innsight shall not be liable for any indirect, incidental, special or consequential damages, or loss of profits, revenue or data, arising from your use of the Service. Our total liability shall not exceed the fees you paid in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Innsight from any claims, damages or expenses arising from your use of the Service, your Customer Data, or your violation of these Terms.
12. Governing Law
These Terms are governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts of Shimla, Himachal Pradesh.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with a revised “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance.
